The change in the mode of procurement cannot be base in the information of end-user.. it is the sole responsibility of the BAC. the BAC will arived to a conclusion on what mode of procurement is applicable will be based on certain circumstance like emergency cases.

I agree with you riddler. while the BAC does make the final recommendation as contained in the APP and approved by the HOPE there could be developments that could emanate from the end -user ; such as biglang nabago schedule for the activity that requires the procurement, or nagkaroon ny calamity or some other change in the situation that the BAC may or may not be aware of initially. In which case, the BAC must be informed by the end-user so that the BAC can make the required modifications in the APP through the issuance of a resolution. In these instances, the change was initiated by the end user but is of course effected by the BAC.

Actually there is no hard or fast rules to be followed. It depends upon the circumstances presented to the BAC. In my opinion, the verified information will have to be supported by proper documentation (preferably in writing) coming from the end-user unit. the rest its up to the BAC to decide.

I agree also. The BAC will make the recommendation on the basis of the information available/presented before it. Who could be a good source of justification but the end-user unit itself? The BAC does make an informed choice when it recommends for the alternative methods and these information should be contained in the WHEREAS clauses. By doing it, the BAC cannot be (solely) blamed for recommending such an option.

Yeah, it is the end-user who shall recommend the change of mode of procurement for the BAC to recommend also the the HOPE for approval.
Actually, we encountered same problem. Lately we received from our central office thru the office which handles foreign assisted projects, wherein the request of the end-user for the use of Single Source Procurement (this is one of the modes prescribed by the World BAnk) was approved by theWorld Bank. This means that our office should have already identified the service provider/consultant to be hired. However, based on the qualification requirements of the position as recommended by the World Bank in its No Objection Letter (NOL), it would appear that we can invite others to submit their Expression of Interest to choose the best. The qualification is not too high. Hence, the end-user recommended the change in the mode of procurement. Just sharing....
