Senate Bill No. 2881

This SB seeks to strengthen transparency measures under Republic Act No. 9184 (RA 9184) by mandating the video recording of all procurement related conferences for procurement projects with a cost equal to or exceeding the amount of One Million Pesos (Php 1,000,000.00).

It also provides that video recording of procurement conferences may be subpoenaed and used as evidence in court.

It prescribes that one copy of the video recording be submitted to the Government Procurement Policy Board (GPPB) and another to the Commission on Audit. Further, the GPPB is tasked to procure the video recording equipment and related supplies which shall be allocated to procuring entities.

This SB likewise imposes penalties under Articles XXI, XXII and XXIII of RA 9184 for violation of the video recoding requirement. In addition, the contract in favor of the errant party, if there is already an award, shall be nullified.

This SB provides that the budget necessary to purchase the necessary equipment and supplies shall be included in the General Appropriations Act.

It was introduced on the 14th Congress by Senator Antonio F. Trillanes IV.

I would like to commend the good senator in the person of Antonio Trillanes for proposing the strengthening of transparency measures under Republic Act 9184 by proposing the video recording of all procurement related conferences for procurement projects with a cost equal to or exceeding Php 1,000,000.00.

However, all that the video can capture are only the formalities during procurement related activities such as the pre-procurement, pre-bid and the bidding itself. The aforesaid activities are already programmed and there's nothing that the video can capture except the proceedings unless of course there is really an anomaly in the use of the BAC of the non-discretionary "pass/fail" criterion during the preliminary examination of the bids which can be noted by the observers if there are any.

The real anomaly such as collusion between the P.E. and the Supplier would come before the procurement activity such as tailor fitting the specifications for a certain supplier which no amount of video could capture since it is considered outside of the procurement activities.

I agree with jomadel86. Collusion arises between the suppliers/contractors/providers among themselves also, which no amount of video recording will cure. Although that is still a good move in the right direction.

Taking video is still not effective in monitoring the Collusion between the suppliers/contractors/providers among themselves because some government officials also participating the collusion. Unless imposition of DEATH PENALTY for all government and non government officials participating in the graft and corruption practices in the Philippines, this problem will not be solved.
