Bid documents

mga sirs, siguro po ito ay nasagot nyo na po ito sa mga previous post (hindi ko lang po ma-locate), pwede po ba makita muna ng bidder/s ang bid documents before nila bilhin ang mga ito? salamat po!

Sec. 17.5 of the revised IRR provides that:

"The procuring entity shall also post the Bidding Documents at its website and at the PhilGEPS website from the time the Invitation to Bid/Request for Expression of Interest is advertised. Prospective bidders may download the Bidding Documents from any of the said websites; Provided that, bidders shall pay the fee for the Bidding Documents upon submission of their Bids."

Under the said provision of the IRR, posting of Bidding Documents in the agency website and PhilGEPS website is made mandatory with the use of the word "shall". Once posted, prospective bidders are already FREE to download the said bidding documents and payment shall only be made for the cost of the bidding documents upon the submission of the bid already.

If the procuring entity does not post at least in the PhilGEPS website (if they don't have agency website yet), it is already violating the provision of the IRR. However, if it really does not post the bidding documents and, hence, the bidder requested to examine the bidding documents first before paying for the bid docs, it is very clear that the bidder has the right to do so.

Yup, those Bid documents can be download from the PHILGEPS website for free. reminder only those bidders bought the Bid documents are allowed to participate in the procurement proceedings. bounce

Does this mean that it is the right of prospective bidders to examine the bidding documents to determine if they can comply with the requirements before they pay for the fees and the procuring entity cannot deny prospective bidders from asking for copy of the bid docs? Thanks.
