Conflict of Interest

Requesting and Approving Authority. [u] Can a requesting personnel/head of unit be the recommending and approving person at the same time of the purchase request, purchase order and DV? I know there is a conflict of interest, but I cannot find any legal rule/provisions of law for the same...any help.

I find this query of BAC Sec which was not answered worthy of a response.

Internal Control System dictates/mandates that the Requesting Officer should be separate or different from the approving officer who is, in all instances, the Head of the Procuring Entity. In the Purchase Order, it is the Head of the Procuring entity that approves it in as much as the Purchase Order is the contract. The form of the Purchase Order which was approved by the Commission on audit,ten years ago does not bear a recommending officer. What is needed only is the signature of the Chief Accountant for the CAF and the signature of the HOPE as the approving authority. this is timely as their are offices whose Purchase Order is cluttered with so many signatures. Again, in cases of doubt, it is best to consult your auditor.
