Guidelines on Comparison of Bids submitted by Cooperatives

3.1 Under Section 32.2.2 of the Implementing Rules and Regulations (IRR)
of Republic Act 9184, all bidders shall be required to include the cost of
all taxes, such as, but not limited to, value added tax, income tax, local
taxes, and other fiscal levies and duties which shall be itemized in the
bid form and reflected in the detailed estimates.
Such bids, including said taxes, shall be the basis for bid evaluation and
comparison.

3.2 Since cooperatives are granted tax exemptions by law, they enjoy a clear
advantage over non-cooperatives.

3.3 To ensure that all bids shall be evaluated on an equal footing, all taxes
itemized by non-cooperatives in their bids and which cooperatives are
exempt from shall be added to the bids of cooperatives strictly for
purposes of evaluation and comparison.

query po. Very Happy since Non-Cooperative bids have different taxes (local tax, income tax) included in their Bid except VAT, which included taxes of the Non-Cooperative is the BAC-TWG going to evaluate and compare vis-a-vis Cooperative Bid? Very Happy

Considering the cooperatives are tax-exempt, the guideline says that "all taxes itemized by non-cooperatives in their bids" will also have to be added to the bids of the cooperatives for purposes of comparison only.

In other words, what the BAC/TWG is going to compare is the original bids of the non-cooperatives and the bids of cooperatives plus the taxes that it should have been subjected to had these cooperatives not exempted from paying taxes under the Cooperatives Code.

After comparing their bids, if the LCB is still a cooperative (despite the added taxes), and if found responsive after post-qualification, the BAC will recommend award to the LCB at its original price (without taxes) or adjusted price (still excluding taxes), whichever is lower.
