Building Permit

HI to all.

We have a special project worth million for infrastructure. It is divided in 3 diffrent proj.
Our problem is this, is building permit a mandatory requirements? Considering the fact that time is being the essence and it is also a government project?

Is there a violation if we will not comply the building permit? Thanks.

I believe your question is way out of this forum. But for purposes of addressing your query, YES, Building Permit is required by the law (PD 1096) and it's applicable to both private and goverment structures.

Section 301. Building Permits.
No person, firm or corporation, including any agency or instrumentality of the government shall erect, construct, alter, repair, move, convert or demolish any building or structure or cause the same to be done without first obtaining a building permit therefor from the Building Official assigned in the place where the subject building is located or the building work is to be done.


Don't because the National Building Code (NBC) has a special "promo" for government agencies and instrumentalies applying for Building Permit:

Section 209. Exemption.
Public buildings and traditional indigenous family dwelling shall be exempt from payment of building permit fees.


Of course, if there's a law, non-compliance is a violation - subject to penalties/sanctions that I need not to discuss further here. Very Happy

thanks for addressing my qustion sir.

by the way the building that we are erecting is a result of public bidding itself or competitive bidding. im just making sure if we are exempted in securing the said building permit.

if we are going to be exempted wat are the rules to be observed? guidlines and other terms and conditions.

it is a special project funded by NAPC. National Anti Poverty Commission.

Only building permit fees are exempted - not the filing nor the process itself. All pertinent requirements must be present for the purpose. To expedite the process, it is recommended that the Building Official prioritize such application over all other permit applications. Cool

In our case as a Government Educational Institution, building permit is being process as the project being implemented. Is their a possibility that building permit be secured by the winning bidder as part of the bidding documents requirement or secured the building permit while the project is on going? Many thanks.
