Purchase of Bid Documents

Are bidders of a previous failed bidding required to purchase a new set of bid document if they will join the re-bidding for the same project?

That all depends on the policy of the Procuring Entity whether to pay for it or not. But basically, bidding documents are non-refundable (as it appears in the Invitation To Bid). That means, whether the procurement proceeded or not, you win or you lose, or even at failure of biddings, the fee is already spent for its purpose.

Moreso, the bid documents' fee is BAC's operational fund (until the introduction of DBM BC 2007-3). Issuance of new set of documents, even for the same opportunity, must mean paying for it (again). Very Happy

Dear Aljune,

It depends.

If the re-bid was in its real sense a re-bid, where there had been no modifications in any of the procuring entity’s requirements, then it would be prudent and fair for the procuring entity, in my opinion, not to let previous bidders pay for the new set of bidding documents.

However, if the re-bid requires major modifications in the bidding documents, then I think it would be reasonable for the previous bidders to purchase a new of set of bidding documents. It wouldn’t hurt though if they are given a discount.

P.S.
I think it would be difficult to establish a hard and fast rule on this issue though.
