Alleged DepEd Anomalies

Dear Ms. Jabat:

Allow me to start my letter with this passage: “An advocate is not the one who speaks of procurement reform, but is the one who makes procurement reform happen.” I adhere to this advocacy, to make procurement reform happen.

One of the basic objectives and guiding principles of the GPRA is to promote transparency. Any excessive effort to reach out the widest range of suppliers/contractors, thereby maximizing dissemination and intensifying competitiveness will never be taken as a liability on the part of the agency. That is the intent of R.A. 9184.

Posting of the Invitation to Apply for Eligibility and to Bid (IAEB) ensures transparency of the procurement process, widest possible dissemination will increase the number of prospective bidders, and intensify competition, in turn, will ensure that the government, in general and the Procuring Entity in particular, will get the best possible proposals as to quality and cost.

No less than the Constitution has ordained the Commission on Audit as the “guardian angel” of government funds and property. The COA adheres to the policy that government funds should be fully protected and conserved.

In the exercise of its jurisdiction, the COA determines whether or not the fiscal responsibility that rests directly with the head of government agency has been properly and effectively discharged and whether or not there has been loss or wastage of government resources.

In view of the above, I would like to inform you in case you close your eyes to it, there are irregularities going on in this government unit with regards to the procurement process which violates R.A. 9184, particularly section 21.2.1 par.(b), to wit:

Invitation to bid must be posted continuously in the PhilGEPS for at least seven (7) calendar days starting on date of advertisement.

The PhilGEPS website shows that the invitation to bid for the construction of school buildings with ABC of P32,732,800 has been posted on July 8, 2010 but was cancelled on the same day or maybe an hour after it has been printed. It was posted only for a very short period of time just to get a printout copy to circumvent the requirement of the law.

Despite cancellation of the said ITB, ten (10) contracts have been executed on August 20, 2010 between the Division and the contractors, namely: Cresta Management & Contruction -3 contracts; 2H2L Construction – 4 contracts; Tapnio Tan Construction, Metrics Construction & Trading and Hibiscus Trading and Construction, with one (1) contract each.

Further confirmation will prove that not a single contract was ever posted at PhilGELPS.

There was no publication as the amount involved for each project does not fall within the requirement of the law for publication. The only way by which the ITB could be widely disseminated was through the posting at PhilGELPS. But there was none.

With the cancellation of the ITB, the bidding process and the execution of the contracts have become illegal hence null and void.

Another anomaly – please refer to the construction project of Simplicio Manalo High School for P9.7 M. The contractor is 2H2L Construction. It was published in SAKSI, a tabloid without general nationwide circulation. The publisher certifies that SAKSI is a newspaper of general circulation only.

R.A. 9184 requires that the invitation to bid must be published in a newspaper at least once in one newspaper of general nationwide circulation. I guess SAKSI is only of general circulation in Metro Manila. It is not nationwide.

Nonetheless, somebody informed us that the issue for the day which contained the publication of the P9.7 M project was bought by a group of contractors monopolizing all construction project of the division. Hence, nobody except them knew of the invitation to bid because the invitation to bid was not also posted at PhilGELPS, a blatant violation of the law.

However, a printout copy was made with reference no. 1391836 without the posting having been activated. You can visit the website and confirm for yourself that the posting is still “in preparation. It was never activated, or in short, not posted at all for the purpose of inviting bidders.

The printout copy was only edited to make it appear “active.” The purpose of the law was railroaded to serve the interest of the few.

Despite absence of the basic requirement of the law on posting and publication, a contract was signed on February 9, 2011 between the Division and 2H2L Construction.

The same thing happened to P3,168,990 project – Ref. no. 1391858, never activated posted only in preparation.

Again, the bidding process and the execution of contracts are illegal.

We believe that these could not happen without the imprimatur of the head of agency, BAC Chairman and the COA auditor.

Our eyes are watching over the latest project with P89 M ABC. I heard 2% bribe money will go each to the Head of the Division (Dr. Meleda H. Polita), The BAC Chairman (Dr. Evangeline P. Ladines), the COA Auditor (Ms. Victoria Jabat), Dr. George Tizon, Mr. Alviz and the Secretariat.

Please be guided accordingly.
