all site inspections in one envelope

during the bidding process it was found out by the BAC that all site inspections of a bidder were placed only in one envelope (copy 2) and the BAC decided to declare the bidder as FAILED in the Second Component of their Bid (Financial Component) but the bidder was given a chance to file for a Motion for Consideration within the required period. Can the BAC consider the motion for consideration as they allegedly comply with the requirements?

Are you referring to affidavit of site inspection? Supposed to be, the affidavit of site inspection is already part of the Omnibus sworn statement. But why was the bidder failed on the 2nd envelope when it is supposed to be part of the 1st envelope?

6.Bidder’s Responsibilities
6.1 xxxx
6.2 xxxx
6.3. The Bidder, by the act of submitting its bid, shall be deemed to have inspected the site, determined the general characteristics of the contract works and the conditions for this Project and examine all instructions, forms, terms, and project requirements in the Bidding Documents.

I believe your agency is using the old PBDs for INFRA which requires the submission of the "Certificate of Site Inspections", however in section 6.3 (Bidder’s Responsibilities)
of the latest PBDs for INFRA 4th edition those requirement is thing of the past.

sir.. good day po.. ano po ba ang proving po ng contractor na na inspect po nila ang site kung wala po silang maibigay na site inspection certificate? kasi po sa DepEd po kasi ang lalayo ng site specially na po yung mga nasa isla po na mga school po.. cguro po depende na po yan sa entity kung yun po ang gusto nila pong requirements po.. thanks po..

The contractor need not prove that he had actually inspected the site. By signing the omnibus sworn statement, which is part of his technical proposal, he has certified that he has complied with his responsibility as a bidder which includes site inspection. So that even if he has not actually inspected the site, at the end, he could not use that as an excuse later, either in contract award or in contract implementation.

In other words, you do not disqualify the bidder just because he could not prove that he has not actually inspected the site, so long as he has submitted, as part of his bid, that GPPB-prescribed omnibus sworn statement and he has signed the same.
