Various Queries (cancellation of bidding, posting, post-qualification, etc.)

This is a clarification.

1. Is there a specific provision in RA that says the HOPE of the Procuring entity approves the cancellation of the bidding process? Is it the responsibility of the proponent/end-user or the BAC to seek approval from the HOPE on the cancellation of the bidding?

2. Is it allowed to award a single contract (scope of work/terms of reference are exactly the same) to two or more contractors?

3. Can the CLC be substituted by a Bank Guarantee as requirement for the Eligibility under the Financial docs, if its computed NFCC is insufficient? Is there a provision in RA on the substitution of the required eligibility docs?

4. If after post-qualification we determined that the bidder failed, can we request the bidder to submit additional documents, other than the required docs mentioned in RA, in order to cure/comply with the requirement?

5. Do we still need to post the requirement in Philgeps and seek quotation in the purchase of a vehicle for an officer which is under the Manager's Car Plan?

I hope to get a clear answer to my queries.

Hi "ierivera" if you wont mind, for clarification purposes, is the Car plan scheme pay to own or given as part of the company benefits to its officers? bounce

Yes. Under Section 41 of the IRR the HOPE (not necessarily with participation of end users, etc.) may cancel, annul the bidding or not to award the contract.

If you mean awarding of two or more bidders in one bidding, yes, provided that lots/grouping shall be indicated in the bidding documents as supported by line item posting in the PhilGEPS. With that you will have to issue separate (sub)contracts for every winning bidder. But if you mean to award a single contract to two contractors, that could only be possible if there is a joint venture (but still JV is considered as one entity).

No. Only CLC and computation of NFCC can substitute with each other.

No. The number of documents, especially on eligibility has already been fixed (no more, no less). RA 9184 prohibits submission of any document to improve one's bid especially after the deadline for submission and receipt of bids. Exception is during Post-qualification (for LCB/SCB/HRB/SRB) and other submittals indicated in the Bidding Documents prior to award.

For as long as public funds are being used, the principles of GPRA and its mandatory provisions including posting in the PhilGEPS applies.
