CSC Rules on Mandatory Position for LGUs

This is really out of the box but would appreciate if someone can provide me answer if this statement has a legal basis or not (NOTE: intended for LGUs) :

1. "In case of vacancies, all mandatory positions must be filled up first before any rank and file positions" (this has to be clarified, if ever, if it applies to the LGU as a whole or by parts/department only); and,

2. "Mandatory positions must be filled up not later than once (1) year after declaration of vacancy."

In the LGU there is 2 categories of position of Department Head to be created the 1) Mandatory and 2) Optional, the optional cannot be created if the LGU exceeds the 55% Personal Services limitation. Mandatory positions may not be filled up if nobody qualified, usually designation/OIC is practiced.

Qualification is not the answer in most LGU to fill a vacant position, in most LGU being govern by a TRAPO or by a POLITICAL DYNASTY, qualification is being set aside, they even designate Consultants as Head of the Department Heads, which in turn creates demoralization among career officers. CSC should see to it that they implement the law, but in this case CSC do nothing , to safeguard the interest of social justice among CSC career officers !!!!!!!!
