Adopting forms of bidding document

Post by Amity_175 on Wed May 11, 2011 12:59 pm

Have a good day! Are we allowed to adopt forms of Contract agreement, notice to award, notice to proceed from other agency?
There are sample forms attached in our bid document but one of our internal control officer showed to us sample forms from other
agency and he suggested if we could adopt said forms which is different from the sample forms attached in the bid document.

Distinguish a "sample form" from a "prescribed form". Sample forms may or may not be adopted (Notice of Award, Notice to Proceed). Prescribed forms are those strongly urged to be constructed and worded as presented (eg. Omnibus Sworn Statement).

In my opinion, Contract Agreement Form is a "prescribed form". I still see a lot of deviations on the use of Contract Agreement and a lot of lawyers still argue on whether to deviate or not. Smile

I'm wondering what could be the reasons, have you tried to ask your ICO? I believe there are agencies have their own customized procurement manuals. bounce

regarding the forms, can we use our cooperative letterhead for the requirements such as technical specs, delivery schedule and the like? thank you!

If your question pertains to your submission of documents (as a bidder), there is no problem with it. Smile
