Creation of Procurement Unit in the LGUs

On matter related to the the discretion of the HOPE to create a new office, i.e. Procurement Unit, to ensure continuity as well as professionalization of the procurement function.

GPM Vol 1 provides that ..."it is advisable for the Head of the Procuring Entity to create the same, not only to serve as the BAC Secretariat, but also to ensure continuity as well as professionalization of the procurement function"

Premises suggests that LGUs have the prerogative to create Procurement Unit in accordance with the DBMs guidelines set for the purpose.

Please, i need confirmation as to my understanding of the abovementioned.

By the way, this LGU has its set up ...... Supply and Property Mg't Section under the Office of the Municipal Treasurer.
That prior to the creation of BAC SEC and or implementation of RA 9184, so to speak, SPMS took responsibility in ensuring proper documentation/mg't on LGUs adherence to the procurement rules and regulation.

Clarificatory inquiry will be.......is SPMS still be considered "procurement Unit" of the LGU as per RA 9184? What happened to the provisions of RA 7160 re: MTO through SPMS to serve as GSO in the local? Can the HOPE, if he pleases, create Procurement Office to serve concurrently as BAC Secretariat in the local?

NOTE: Republic Act 9184 expressly amends Title Six, Book Two of Republic Act No. 7160 (R.A. 7160), otherwise known as the “Local Government Code of 1991,". So SPMS may not be totally consistent with the GPRA anymore. Smile

Coverage of DBM NBC 517 is limited only to national agencies. Effort exerted in the hope of finding references for the creation of procurement office in the Local is in vain. May i solicit your expertise on the matter?
But first, is there any referenceguidelines for that matter (creation of proc unit in the Local)?
