10% mobilization for goods supplied abroad

Hello, everyone! I would like to ask if the procuring agency is allowed to pay the 10% mobilization for goods supplied abroad if the contractor is Philippine based? Thanks.

MO 15 was signed by the President yesterday allowing advanced payment up to 15% of the contract amount for goods, whether supplied from abroad or locally, provided the supplier will post an irrevocable L/C or bank guarantee for the equivalent amount of the advanced payment. Since the MO was just signed you need to wait for publication period before it takes effect. Here is the LINK to that news item.

Salamat po sa reply. May pahabol po akong tanong. So hindi pa po allowed ang advanced payment sa transactions prior sa effectivity ng MO 15?

The memorandum order was signed May 09, 2011.

Many would ask if this issuance can cover projects for delivery/implementation starting 09 May 2011? This can create a cloud of arguments. Nevertheless, I think MO#15 can be validly applied [only] to those procurement activities posted (1st day of advertisement) after 09 May 2011 - that is if we read between the lines and if it should serve the original intent of the amendment.
