Technical Specification

If a lone bidder quoted a lower specification than what is asked is he still considered a compliant bidder or not? and can the bidding can be awarded to him? Is it allowed for him to make a certification to deliver the item with the exact specification rather than the item that he quoted? and can this be said "advantageous to the government" for it has a lower price?

This practice is NOT advantageous to the government. It defeats the purpose of the law. If the bidder submits a lower specification, definitely it is lower in price. But will the goods/services be delivered/rendered in such a way we get the same results? I believe it won't.

If the bidder used an inferior specs, he/she shall be disqualified. If the bidder used the exact specifications, that okay. If the awarded bidder delivers superior specifications than that quoted or bidded, that is still okay, provided however, that the actual items are reflected in the PO and Delivery/Acceptance. That is when it will be "advantageous to the government". Smile

In reference to the bold underline text, may i share opinion, the bidding process involves the using a non-discretionary “pass/fail” checklist criteria. If bidder submits the required technical specification as required, it shall be rated “passed” for that particular requirement. However if, bids offered fail to include any requirement(s) or that are incomplete or patently insufficient shall be considered as “failed”. Moreover the BAC cannot ask the bidder to submit additional requirements to make it compliant with the requirements.(Certification as to the Specs). My take on these topic. Peace bounce
