Should we consider a late quotation under negotiated procurement or repost the item?

The procurement of an item failed under negotiated procurement due to no quotation received.
Couple of hours after the deadline we received a quotation for the procurement of the failed item from a courier.
The question is, should we consider a late quotation or we should re-post the item.

if you stipulate in your posting of negotiated proc (under 2 failed bidding's) that "Late Submission shall not be Accepted" with setting of time & date, then definitely you should re-post the said item for another schedule, if none, then you may consider the quotation. why not set the time of deadline for the whole day? can't they submit their quotations thru e-mails?
excerpt from revised IRR: "53.1.2. The BAC shall invite and engage in negotiations with a sufficient number of suppliers, contractors or consultants to ensure effective competition." must also be based on your available shortlisted eligible suppliers.

the item is under negotiated procurement -small value. The item has been posted for more than 7 days and since this is not the only procurement we had under similar category the BAC agrees to set the Opening of Quotation in one day at a certain time and late quotations will not be entertained, thinking that there will be three or more suppliers who will participate the activity.

We prefer original or "certified true copies" of the documents of the suppliers that is why we opt that their quotations and other supporting documents will be send thru a courier or by a representative.

Unfortunately no one submit a quotation for the procurement of particular item on time. We received the quotation in the afternoon.

Should we? Since it is a negotiated procurement and no one submit a quotation, we should consider the quotation.

or

Re-post the item and set another date for the opening of quotation and wait for other suppliers to submit their quotation.

Sir you're saying we should re-post the item, which I believed the safest action.

Is there any legal implications if ever we opt to consider the late quotation in a negotiated procurement wherein it is the only quotation we received for the procurement of the item where it was posted for more than 7 days.

For me, I suggest you postpone the deadline (you need to postpone your PhilGEPS advertisement). You should not consider outright the quotation upon receipt but you still give equal opportunities for others to participate. You may extend it for another 7 days depending on your assessment and then you finalize your list of participating quotations.

You don't need to repost because theoretically, there should be no FAILED Negotiated Procurement. Smile
