Failure to Actually Post in the PhilGEPS

To Sir RDV or Anyone. Good day.

This is to seek clarification whether or not it is in order to postpone the schedule for the opening of bid and the re-holding of the pre-bid conference for failure on the part of the BAC secretariat to actually post the ITB in the PhilGEPS. The facts are as follows: On July 20, 2011 the BAC Secretariat posted (according to them) the ITB for the bidding of an infra, the pre-bid conference was held on July 25, 2011 and supposedly the opening of bids was last August 1, 2011. Four prospective bidders attended during the said pre-bid conference. However, the BAC found out that there was no actual posting/publication of the ITB in PhilGEPS. The ITB was only successfully posted/published on August 11, 2011 with some modifications,(.e., pre-bid on August 15, 2011 and opening of bids on August 22, 2011). A Bid Bulletin No. 1 regarding said changes in the Bid Book was issued on August 11, 2011.

Our questions are:

1) Is there still a need for such re-scheduled pre-bid conference?

2. Is it in order to accept other/additional bidders who responded to the actual posting/publication in PhilGEPs other than the first four bidders who attended the July 25, 2011 pre-bid conference.

3. Was the conduct of said July 25, 2011 pre-bid conference in order in spite of the failure to actually post/publish the ITB?

Kindly enlighten us on the foregoing issues.

We need quick response on the matter.

My straight take:

1. Yes, especially if the ABC is above 1M;

2. Yes, you should;

3. Considering that there were bidders who attended pre-bid, then they may have seen the ITB somewhere else (website, conspicuous places, or newspaper), hence you may consider the pre-bid as valid (although may not be in proper order);

To me, it would be prudent to conduct a deeper investigation on why PhilGEPS posting was not complied. Was it a simple neglect? Or an intentional one? Nevertheless, the new schedules were not compliant with the provisions of RA.9184 particularly the very short notice of pre-bid and violation of 12-day requirement from pre-bid to deadline of submission/receipt of bids. Thank you sir Jhez. I think there is really a need to look deeper into the non proper posting/publication and the very short period(s) of activities.

What other necessary action should be taken on the situation?

I suggest you (re)post the entire process compliant with the minimum time elaborated under Annex C of the IRR. You will have to consider the most recent pre-bid in complying with the 12-day requirement. Smile

Considering the workload and responsibilities of the BAC Secretriat, another well deserved experience. but in order not happen similar situation, audit trail will have to be conducted to identify the causes and provide safety measures in the future. cheers bounce

Sorry, Nheil, I was unable to answer your earlier query. (Consider me a 'now-you-see-me-now-you-dont' member of the forum due to the demands of work). But, engrjhez has adequately answered it.

Your guide to the requirement that the pre-bid conference be held at least 12 calendar days before deadline for bid submission/bid opening date should be the last pre-bid conference.

If (successful) posting was done only only August 11, then the pre-bid conference that was done on July 25 cannot be considered as a pre-bid at all since it was done prior to the posting requirement. You will need to conduct a pre-bid conference again.

In your new post on August 11, your pre-bid is August 15. The pre-bid should be held after the last day of posting, so it should not be earlier than August 18. Therefore, your deadline for bid submission/opening date should not be earlier than August 30.

You will need to issue another bid bulletin to change the dates, but it could be too late for that now.

They really have to issue/post Supplemental Bulletin for the changes in schedule following the suggestion of engrjhez and sir rdv. With this, they can still push thru with the bidding.

Fail to post in PhilGeps the Procurement of Goods

Greetings. . .
In addition to above Issues and Concerns, a certain agency failed to post in the Philgeps the Procurement of Goods above 1M. Verification by my liaison on said agency responded that they have posted it in the PhilGeps Web Site, however upon browsing on the previous opportunities of concern agency in the web, i have found nothing about the said goods, info gathered said they have posted it in the Bulletin(likely agency bulletin). My question are
1) can Philgeps certify if said procurement of goods had really been posted or not?
2) who is the right person to contact in the Philgeps department? 5849619 is not yet in service when tried calling
3) Is their a violations made by the BAC/HOPE if the delivery had already been made of said Goods?
4) what should i do to help things in the DAANG MATUWID tayo dapat?
5) what possible sanctions will implicate to the BAC/HOPE should proven they have intentionally fail to Post the Procurement of Goods? (previous goods been usually posted only recently they don't)
