A PERMANENT PLANTILLA for the BAC SECRETARIAT

Section 14.1 of the Revised IRR of RA 9184 states:

The Head of the Procuring Entity shall create a Secretariat which will serve as the main support of the BAC. An existing organic office within the procuring entity may also be designated as Secretariat. However, to strengthen and promote the professionalization of the organizations'procuring unit, the Head of the Procuring Entity may create procurement units that may serve concurrently as BAC Secretariat.

Question: In the Local Government, the General Services Office is the Procurement Unit (LGU) right? IS SECTION 14.1 WHEN IT STATES THAT "THE HEAD OF PROCURING ENTITY SHALL CREATE A CREATE A SECRETARIAT" IS MANDATED TO CREATE ONE OFFICIALLY WITH PERSONNEL TO OCCUPY A PERMANENT PLANTILLA POSITION?

PERSONALLY, I beleive mandating a creation of permanent BAC Secretariat with permanent plantilla position is the most effective way to professionalized the system of procurement. In reality we will know that IT IS THE BAC SECRETARIAT mostly perform all the duties and responsibilities under the Procurement Law. Let us admit it, most of the BAC Members na inilalagay ng mga HOPE pupunta na lang mga yan pag me meeting, yung hirap ng preparation sa mga documents at sa lahat ng mga need na required ng law nakapatong sa Secretariat.


SO PLEASE, MANDATE the CREATION OF BAC SECRETARIAT with PERMANENT PLANTILLA POSITION.

sa dame ng trabaho ng BAC Secretariat, impossible na makapag double duty pa yung mga taong designated from other offices. If we really professionalized the system, I think this is the key.

Actually, DBM had issued NBC 517 dated December 22, 2008 to address the issues and concern, for similar topic follow the LINK for details. bounce

@khalel....

Misconception as i may call it.........if you consider the GSO/Supply and Property Management sECTION of an LGU as the Procurement Unit in the Local at least in my understanding of the new Law (RA 9184). Provisions of RA 7160 regarding PROCUREMENT has been AMENDED. There is no way a BAC Secretariat Function or Procurement Function may be dispensed with BY any Section or Office of an LGU unless there is an Order from the HOPE mandating the compliance of its inherent responsibilities.

Worst if you assume that BAC Secretariat functions indicated in the IRR are inherent responsibilities of GSO/SPMS. (tRY LUKING AT THE fUNCTIONS OF A GSO in the Local Code). GSO/SPMS cannot act as BAC Sec unless an order from the HOPE designating such to act and perform the BAC Sec functions.

The 3 options mentioned in the previous discussion made by EngrJHEZ is just right in my understanding. (To create BAC Sec, Designate organic office..)

Moreso, there is no Procurement Officer nor Procurement Office in an LGU. The plantilla position such as Procurement Officer and the likes are not at all available in LGU setting.

Simply put Supply and Property Management is so different form Procurement Management..........
