Area of concern:
1. The creation of separate BAC Secretariat is no longer feasible? (Sec. 14 RA#9184 and its IRR-A)
2. For Internal control systems the responsibility for delegation of authority and accountability for procurement related activities should be properly identified.
3. For those GOCC/GFI with existing Procurement Unit (Department, Division, Section level ) but cannot comply the requirement as specified in 5.2 of the NBC 517
Example: Procurement Division Level Existing - But cannot comply the APB as specified will it retain or
downgrade their organizational structure
4.The Head of the procurement Unit shall be a regular member of the Technical Working Group of the BAC. Agencies are also encouraged to designate the Head of the Procurement unit as a regular member of the BAC/s if s/he meets the requirement prescribed by Section 11.2.1(Head of BAC Secretariat any comment?)

IRR-A Sections 5(q), 11, 13, and 14 provide for the legal reference for the organizational structure.

The following guidelines may be considered by the Head of the Procuring Entity in organizing the Procurement unit/Office:

1V. The following organizational set-up may be adopted by the foregoing procurement organizations: (See Figure 1 and Tables I and II )The positions indicated in Figure 1 shall be filled up using the “scrap and build” scheme, i.e., reclassification or transfer of filled itemized positions, or abolition of vacant itemized positions and reclassification of these positions into the above positions. If the latter scheme is adopted, the equivalent Personal Services requirement should not exceed the amount generated from the abolition of vacant positions.

In the Barangays, the Treasurer shall serve as the Head of the Procurement Unit/Office.

The Head of the Procuring Entity shall ensure that the Procurement Unit/Office will have a sufficient number of personnel who will provide secretariat support to the BAC and perform the other functions of the Procurement unit/Office, as provided in this Manual. The said Unit shall be strengthened through continuing procurement training and education of the staff and deployment of additional personnel, if necessary.

I been trying to piece together the missing link in Figure 1 and Tables 1 and 11, but the GPM volume 1 provides none of those figure(1) and Table exist(1,11). Did the GPPB forgot to provide those reference(figure and Tables) or this NBC 517 dated December 22, 2008 Guidelines on the Establishment of Procurement Units is the missing reference on the GPM? Gud pm po. Query lang po for any updates on the creation of BAC Secretariat as an Office? What could be the legal basis for the creation of BAC SEC as an office and the plantilla positions that will be created and the methodology in the filling-up of these positions?

Legal basis is found in the IRR of RA 9184:

14.1. The Head of the Procuring Entity shall create a Secretariat which will serve as the
main support unit of the BAC. An existing organic office within the procuring entity
may also be designated to serve as Secretariat. However, to strengthen and
promote the professionalization of the organizations’ procuring unit, the Head of the
Procuring Entity may create procurement units that may serve concurrently as BAC
Secretariat in accordance with the guidelines issued by DBM. x x x

Also, the positions to be created (if any) must be found in the Index of Occupational Services (IOS) and must follow the required staffing pattern of the DBM. Smile

May I ask, if the head of the Procurement Unit is either a member of the TWG or the BAC, will he/she be entitled to honorarium?

yes, the head of the procurement unit who is also a member of the twg or the bac is entitled to received honorarium. the prohibition is only against procurement unit staff or head as member of the bac sec shall be prohibited to receive honorarium.
