Delayed in Payments

Hi, it's me again. Ano ang dapat gawin pag 10 months delayed ang progress billing? Sa side ng contractor na comply lahat at nai submit ang nasa check list ung kulang na document/ attachment ay maggagaling sa Procurring Entity at wala akong control doon. I dini delay ang release ng document paisa isa. Alam naman natin na pag na delay ang payments masisira ang cash flow ng contractor. Hind ba magbayad ang Procurring Entity ng penalty sa contractor sa delayed in payments? Thanks in advance.

May we know what document is it? If it is the inspection report or statement of work accomplished, the concerned should act on it promptly within five (5) working days (from receipt of your request for billing). If that is not satisfied, you may file complaint to the CSC or to the Office of the Ombudsman for violating RA 9485 (Anti-Red Tape Act).

engrjhez salamat po sa reply nyo. COA inspection report po ang huling kulang dahil walang auditor na mag inspection kahit napakatagal na ng request. Yung ibang document piece by piece inilabas ng Procurring Entity as if na hindi nila alam ang mga document na manggagaling sa kanila. Ako rin po ung nagtanong re: advance payment. 4 tranches ung naging payment namin sa advance payment halos 8 months ang inabot bago mabayaran. Sa SCC sa bid docs walang provision na nakalagay tungkol Advance payment. Tapos sa progress billing ten months delay din po. Pwede po bang i terminate ko ang contract due to above mentioned problems? Napakahirap po kasi ng kalagayan namin. Pls guide me what to do.
By the way ano po ang ibig sabihin ng CSC?

GCC = General Conditions of the Contract
SCC = Special Conditions of the Contract

Mayroon po sa General Conditions of the Contract na provision sa remedy ninyo sa delayed payment ng Procuring Entity under GCC Clause 18(d)

(d) A payment certified by the Procuring Entity’s Representative is not paid by the Procuring Entity to the Contractor within eighty four (84) days from the date of the Procuring Entity’s Representative’s certificate;
