MUNICIPAL ENGINEER AS A MEMBER OF THE BAC AND THE HEAD OF THE BAC SECRETARIAT FOR INFRA

GOOD DAY.... THE same case with Procurement of Infrastructure ...can the municipal engineer head the secretariat for infra by analogy he is the head of the engineering department and perform as a member of the BAC

It's good that you have two Head of SEcretariat (Infastructure and Goods). But, to make the Municipal Engineer as the HEad of BAC Secretariat for Infrastructure may not be good for the health of the GPRA. Let the Mun Engineer function as a BAC member. In my opinion there must be some degree of independence between the BAC,TWG, and the Secretariat. They should be looking its other's back for transparency.

This is a direct violation of Section 14.1 of the IRR, to wit:

  • 14.1. The head of the procuring entity shall create a Secretariat which will serve as the main support unit of the BAC... x x x

The law uses the singular form to imply a single Secretariat. Note that the BAC and TWG were not given the same exclusive treatment.

Under the updated manual of RA 9184, depending on the complexity of the activities which I believe as technical personnel for infrastructures they are the most qualified staff to be at the Secretariat for infra

Even the IRR encourages a single BAC. Section 11.1 states that:

  • "Each procuring entity shall establish in its head office a single BAC to undertake the functions specified in Section 12 of this IRR-A. However, to expedite the procurement process for practical intents and purposes, the head of the procuring entity may create separate BACs where the number and complexity of the items to be procured shall so warrant. x x x"

The option was to create multiple BACs depending on practicality. Since the TWG is dependent on the BAC, multiple TWGs may also be created. The Secretariat is treated differently as it has its own definition and function on Section 14. Moreover, there would be conflict of function(s) designated to the BAC Secretariat if there are two or more of them. Quoting Section 14.1:

  • x x x
    10. Be the central channel of communications for the BAC with end users, PMOs, other units of the line agency, other government agencies, providers of goods, civil works and consulting services, and the general public.

How can this be performed if there are two or more Secretariat?
