I think the proper action for the BAC member is to resign from his membership in order to avoid any situations that would involve or would result into conflict of interest. Although the BAC member's son/daughter could just be a mere employee in the construction firm, that could still influence his position in the BAC or would be perceived as giving an undue advantage to the construction firm.

If the award to the individual consultant was a result of negotiated procurement as provided for under Sec. 53.7 of the IRR, upon prior recommendation from the BAC and approval by the HOPE, and considering that negotiation is made directly with the individual consultant, the latter may no longer be required to submit eligibility requirements which are mandatory if it was done through public bidding.

It can be done either by all the members or any member of the BAC. To be entitle to the free legal assistance granted to the BAC under the law, the latter has to be aware of and has to follow the implementing guidelines prescribed by the GPPB for the purpose.

The proceeds from the sale of bid docs can only be used exclusively for the payment of honoraria and/or as funding source for legal assistance, medical assistance, liability insurance authorized under RA 9184.

It is of course prohibited under Sec. 19 of RA 9184.
