CONTRACT EXTENSION PENDING BIDDING

can a procuring entity extend the contract with a supplier of certain goods, even though their contract has already expired and there's already a public bidding for the same goods? the entity, in extending the contract, does not want their day-to-day operations disrupted by the "gap." Thanks

May I ask for clarification, are you referring to the contract delivery time schedule in the contract? or the actual delivery of the certain goods as specified in the contract.? bounce

Once the contract expired, it cannot be extended. The contract should be extended before it expires.

i both agree and disagree with your statement....

i agree in the sense that contract should be extended before it expires, as this will show that the two parties are doing thier obligations with due care and diligence.

on the contrary, i have to disagree about a contract that could not be extended when it expires;

in my opinion, there are several options that can be adopted to extend the contract time for completion even if it already expires;

1) both parties have agreed to extend the contract competion
2) levy liquidated damages to extend contract completion


just my opinion.....

experts, please share your insights...

Hello Elib...

Once the contract expires, it cannot be extended because there is no more contract once the contract expires. If a contract that expired concerns an unfinished project, a claim for liquidated damages against the contractor is the remedy, not contract extension. Besides, the performance security is effective only during the lifespan of the contract and once the contract expires, the performance security also expires. Please share me what idea do you have in Clause 19 of the General Conditions of the Contract-Goods.

thank you for your explanation....


to further up my point,.. the forum topic is about contract extension (time for completion expires but still have outstanding works) that is why i have jumped the gun to that conclusion.

yes, your are correct and i agree with you that liquidated damages is a security in favor to the PE (remedy), if the other party is in breach for the projects timely completion, it is one way we look at it.

seeing it on the other end, liquidated damages is something that the contractor can use at his advantage to extend his time for completion (of course this is not an ordinary conception).

Clause 19 of the General Conditions of the Contract-Goods is a stipulation wherein, if the supplier is in breach of contract for the timely delivery/completion of the project the PE can be compensated for that breach.

the extension should be made during the lifespan of an existing contract and with the approval of GPPB.

Inquiry with Contract Extension with the Exclusive Service Provider

Gentlemen,

May I seek your opinion and expertise pertaining to the  "Preventive Maintenance Agreement" contract, (for example say Elevator Equipment), normally with the exclusive Service Provider. There is a provision in the contract that the services of the (Exclusive) Service Provider may be extended on a "month to month" basis while awaiting the result of the renewal of the said contract. The Procuring Entity (PE) invokes the provision of the contract, of course before its expiration period.

Considering that the said contract provision is binding, and if my recollection is right there was an issued resolution governing the procedure that requires P.E. to officially notify or is it seek approval? to the GPBB that the said provision is being invoke and availed so as not to compromise the operation of the equipment.

May we be clarified the proper procedures that is mandatory to be undertaken by P.E. to secure the safe implementation of the contract to abide  the Revised IRR of RA 9184. May we be guided where to find the GPBB resolution and or Office/Department  Orders that covers this issues.
