On BAC Resolution - Signing of BAC Members

Post by striker on Fri Nov 18, 2011 2:16 pm

Hi everyone, kindly enlighten us with this situation. Is there any guidlines that we can refer to if we are being forced to sign such BAC resolutions etc even if we have disenting comments/opinions? That if we do not sign, we may be charged with insubordination.

Many thanks po.

If there was a dissenting opinion or comments during the deliberation, the chair should have put it into votation so that those who wouldn't agree with the procurement at hand need not sign the resolution.

If you have some reservations or dissenting opinion and you are still being required tonsign, you may sign but you can indicate your reservations below or after your signature, particularly if you agree only on certain aspects of the resolution and not on the whole resolution itself.

In addition, if not all members agree on the content of the resolution, then the WHEREFORE clause must not be worded UNANIMOUSLY as it will mean that all of the members agree. Instead I may suggest wording it as RESOLVED BY MAJORITY VOTE. Of course I would perfectly agree with RDV's proposition to indicate the dissenting opinion as part of the decision. Smile

I dont think refusal to obey some order is a ground for insubordination, remember BAC is a collegial boby were the power and authority are vested among colleagues. If a member refuse to sign the resolution by all means you can, provided it should be reduce into writing. bounce
