EXPIRED PCAB LICENSE

Good day to all...

Consider this situation: On the day of Opening of Bids, Company Z submitted an expired PCAB License which is one of the eligibility requirements. The BAC declared Company Z as "INELIGIBLE" bidder. After two days, Company Z filed a motion for reconsideration with attachment of Temporary License Renewal from PCAB. The BAC verified and confirmed that the PCABoard has not convened yet so a temporary license was issued to Company Z and so the BAC granted their request.

Will the BAC not violate any provisions of R.A. 9184 in this respect?

I think Company Z should not be given a bidding documents, because they are not eligible, therefore not qualified to attend bidding, hindi na sana aabot sa ganyang situation. Thank you.

A Temporary PCAB License is acceptable, however, since what was in the technical envelope on bid opening day was an expired license, the BAC should not have accepted the Temporary License when the bidder submitted the same when the latter submitted its request for reconsideration. A finding of fault on the part of the bidder, which is the submission of an expired license, and considering that on opening day the BAC is using the pass-fail criteria, the BAC cannot reconsider its decision of declaring the bidder as failed.

The BAC decision, therefore, of reconsidering its decision is not in accord with the law and its IRR, including the provisions of the bidding documents.

facts: the BAC declared our bid as "failed" because according to them we submit an expired license with the expiration date on february 27, 2012. as indicated in the PCAB license we've submit during the bid, the validity perod of the license/renewal as indicated under the licensed particulars is july 01, 2011 to june 30, 2012. however, under the registration particulars, it indicate that the validity period of the registion is february 27, 2009 to february 27, 2012.

may I ask, which should prevail, the License particulars with the validity period from july 01, 2011 to june 30, 2012 or the registration particulars with the validity period from february 27, 2009 to february 27, 2012?

Sir if I may answer this, . . both license and registration particulars should not be expired or not already lapsed. Either one, if expired, will cause failure in criteria.
This is why. . (I presume you submitted a bid in a govt bidding thats why your inquiry came its way here in GPPB forum). . .The PCAB license is renewed annually, this is the license needed by the contractor in doing private and govt projects. The registration particular w/c is renewed every 3 years (i think), is for Govt only. This is not required in private projects. It is clear here that for Govt projects both should be valid.

I concurr with sir RDV, temp license is acceptable if included in the submitted documents otherwise it is a clear failure in criteria. MR for this situation is not acceptable unless otherwise there is a clear indication of fault by the BAC or vague or confusing instruction/s in the PBDs that causes the submission of expired PCAB license.
