Resolution By the BAC members

Sir:

According to our BAC Secretariat, posting cannot be done in the PhilGeps website regarding the posting of supplies to be purchased by alternative mode of procurement of supplies amounting to more or less 50k, so the BAC made a resolution authorizing itself to proceed with the procurement approved by the HOPE without the need of posting it in the philgeps website for seven days. Is this Legal? or is the resolution enacted by the BAC self serving? Please Help.

your bac sec is right. and it is legal. no need for a bac resolution.

GUIDELINES FOR SHOPPING AND SMALL VALUE PROCUREMENT

3. PROCEDURAL GUIDELINES

d. RFQs shall also be posted for a period of seven (7) calendar days in
the Philippine Government Electronic Procurement System (PhilG-EPS)
website, website of the procuring entity, if available, and at any
conspicuous place reserved for this purpose in the premises of the
procuring entity. However, in the following instances, this posting
requirement shall not be applicable:

i. When there is an unforeseen contingency requiring immediate
purchase under Section 52.1(a) of the IRR; or
ii. RFQs with ABCs equal to Fifty Thousand Pesos (Php 50,000.00)
and below.

Please Help.Under procedural guideline 3.d of the GPPB Resolution 09-2009, fifty thousand and below procurement shall not be posted in the philGEPS anymore. This is for purposes of fast tracking the procurement and I agree with ikuz23.

So sir this means that for RFQ's with ABC of more than 50k its mandatory to post it in the PhilGeps for 7 days, but how about if we cannot post it in the PhilGeps for technical reasons, say we cannot find a page in the PhilGeps where to post this RFQ's with ABC of more than 50K as it happened in our case as per information from our BAC secretary that we cannot post it, What are we going to do? which returns back to my question earlier that is it legal and not self serving for the BAC to enact a resolution approved by the HOPE authorizing itself to procure without posting the RFQ's in the PhilGeps? Is there an alternative step to this kind of problem?Help Pls.Thanks.

I think it is still legal as long there are a justifiable reasons but next time you should send your BAC secretariat to a Philgeps training conducted by GPPB.

We have also experience that predicament and what I did was informed our state auditor that the philgeps website is down. So I post our Invitation to Bid only in three conspicuous place with a note "PhilGEPS website is down during posting"
