Is a government employee qualified to represent a private company in a bidding in a government project?

I think it is legal as long as there is no conflict of interest exist.

Happy New Year! It is illegal if the private company is joining a bidding where the employee is working!

The issue here is not qualification. The official has opened himself to being charged in violation of RA 3019, specifically Sections 3,4 & 5. He can also be charged of malfeasance under Tort Law. Again, I would like to solicit the professional comment of a lawyer here.
