Progress Billing for Infra Projects

Sir/Madam:

Good day to you sir/madam. If the contract states that progress billing will be made in every 25% accomplishment of works and the supplier did not submit a request during the 25% accomplishment of SWA but instead they made their request only during the 50% accomplishment, is it legal or of no violation that we'll process the progress payment of 50%? or even at 75%?

If that provision on progress billing of "every 25% accomplishment" is really in the contract, I think that it should be interpreted to mean as the minimum percentage of accomplishment before a progress payment could be requested and processed. If the works is already more than 25% and the contractor or supplier has not yet requested for progress payment, it should not be taken against the contractor or supplier.

thanks RDV @GP3i for your reply. this was the issue raised by our accounting department that the billing should be followed literally as what is written in the contract. thanks for the reply.
