Amendment to Order

Good day to all, I would like to seek for clarifications with regard to Amendment to Order for the procurement of goods as discussed under Annex "D" of the revised IRR of RA 9184.

Recently we had completed the procurement process for a project worth P225k. During the course of project implementation, our Supplier had identified some components or parts that needs replacement and this was acknowledged by our implementing unit.

Annex "D" of the revised IRR provides that Amendment to Order may be allowed for a maximum cumulative cost of 10% of the original project cost, provided that approval of the HOPE must be present. The additional cost needed for the replacement parts is P15k or 6.67% of the original project cost.

The questions are:

1. Can the above said provision under the revised IRR of RA 9184 be adopted by our office?
2. Is the same rule will apply as to Variation Order for infra projects? Whereby the implementing unit shall be the one who will recommend or seek the approval of the HOPE. Or is it the BAC who will do such function?
