good morning!

pareho po ba ang procedures ng public bidding and public auction? like if after two failed auctions eh pwede na i-negotiate? may guidelines po ba kung pano kapag negotiated na method? thanks po.. Smile

In RA 9184, we use the term public bidding or competitive bidding and not public auction, although it could also mean the same thing. In RA 9184, negotiated procurement is allowed after two failures also (Sec. 53.1 of RA 9184 and its IRR). In case of negotiated procurement due to two-failed bidding the guidelines are provided for in Sec. 53.1 of the IRR.

PUBLIC AUCTION REFERS TO DISPOSAL, MEANING THE AGENCY WILL SELL PROPERTIES TO THE PUBLIC, WHILE PUBLIC BIDDING IF THERE IS A PROCUREMENT BY THE AGENCY, THEY ARE GOVERNED BY SEPARATE LAWS, PUBLIC BIDDING = RA 9184 AND PUBLIC AUCTION = RA 7160.

You are correct in a sense, jovinal. Public bidding is generally applicable to procurement, while public auction is to disposal, but both of which requires competition.

Although in some literature it is often used interchangeably, as auction also involves public bidding. In other words, public bidding is of general application. However, for purposes of RA 9184, since it covers only procurement, public bidding is only with regards to procurement and not to auction.

sir, good AM. yung RA7160 is applicable lang po ba sa LGU. Can we also apply RA 7160 for GOCCs?

That is only for LGUs. If you are asking for the disposal of properties, there are COA guidelines regarding that. You can adopt the said guidelines.

For your informaton and guidance, follow the LINK , The procedural guidelines some what similar to public bidding, it includes the Public action, sale thru negotiation etc. Good luck. bounce

i think the best person to answer your question is COA or your resident auditor. sila po kasi ang gumawa ng coa audit circ. no. 89-296, accdg. to the link provided by sunriser431.

In the case of LGU, there should be an Appraisal and Disposal Committee that would recommend to the COA the value of the property to be disposed whether through auction or condemnation. The COA will make an evaluation of its own and would render the final value of the property to be disposed. That's what the procedure we made when we decided to auction one of our property.

Just like the procedure in RA 9184, after to failed auction the agency can resort to negotiated procurement.
