Bidding Process and Bid Docs

An agency requesting us to handle their bidding process because wala daw silang BAC dahil hindi raw sila makabuo (kunti lang yung empleyado nila). as we inspect and during pre-procurement conference sila na raw yung magprepare ng lahat ng mga bids docs including the schedule and other requirements. our only job is to facilitate the process.as we evaluate their bids docs requirements, we learned that they are using the old PBD wherein, the BAC require all documents needed during the entire bidding process. di ba sa new PBD, kunti lang ang ni require natin during opening of bids, sa 1st envelope legal at tech lang (mga almost 7 docs lang depende sa ne require nyo) tapos sa 2nd yung financial (almost two lng). if we follow or use as what they require and we will not following the new list of requirements, di ba kami matechnical nito as BAC? iba kc sa bagong IRR......tulong naman jan...tnx..

Since it is your BAC that will be doing the procurement, it is prudent that you do not proceed with the procurement process unless the procuring entity adopts and uses the procedure under the revised IRR and new PBDs (4th edition) for the bidding documents. Your concern is very much valid. Hindi lamang baka ma-technical kayo, baka ma-legal violations pa kayo. You won't want to put your heads on the line trying to help another agency procure for them.

In an Agency to agency procurement, which is I believe what you intended to do, Memorandum of Agreement is very important. In as much as you, under the MOA wull undertake the procurement for them, then it should be you will prepare all the needed documents, and ergo, I am sure you will be using the appropriate forms and documents. I hope I am right on this... and so the question raised could have been averted...

Meeting of minds is solution to your concern. You have to inform the Bidding procedures to be adopted and use the latest 4th edition of the PBDs . Otherwise if they are not amenable to the proposal you presented, the only option not to engage and accept the services. bounce

Follow-up question: if we continue the bidding process regardless na kahit iba ang laman ng mga envelopes (sa 1st envelop kasi nila nilagay ang financial requirements with the legal and technical tapos sa 2nd envelop, yung bill of quantities lang ang nandoon with corresponding bid price at lahat na kailangang documents sa post qualification ay nandoon rin sa 1st envelop*) and if we will continue the bidding kasi accordingly nadistribute na daw ang mga bid docs and the procuring entity are running out of time changing the bid docs, may pananagutan ba kami as BAC since the procuring entity prepared everything and they want that our job is just to open the bid during bid opening at sila na ang bahala sa ibang proseso.

can anybody give me a link that require all BAC/Procuring entity to observe the new PBD's.


Next question...sa 2 envelop system, kapag ang isang document ay nasa kabilang envelop instead dapat nasa 2nd envelop pero sa 1st envelop nalagay, pwede ba itong ground for ineligibility sa isang bidder to bid?

On your next question, maaaring hindi ito maging ground for ineligibility (kung hindi naman Class A documents ang na misplace) pero kapag may nawala sa 1st envelope na dapat nandoon, ground siya for "disqualification" dahil mare-rate siya na FAILED. Same is true kung yung nasa 2nd envelope ang napalagay sa 1st envelope. Smile

I am wondering how powerful was that requesting agency that you had to follow them despite the glaring discrepancies which you were well aware of and even called their attention to it.

I wonder what came out of it.

Any update re this concern sir bob.gals?

We really follow the new IRR with the new Bid Docs.. kung ano ang nasa IRR, yun talaga ang sinunod namin. nag okey naman lahat yung nakabili na ng Bid Docs nila.nag issue kami ng new list of requirements at lahat naman ng nakabili ng bid docs sumunod naman sila lahat...as of now ongoing na yung project na sumunod sa tamang proseso ng government bidding...tnx sa lahat na nag advice....
