Actually you only ask from the pre selected suppliers to submit their proposals. If you have read the provision of section 53.1.2.2 government agencies are mandated and required to kept registry of suppliers, contractors etc. and it will serve as the basis for the BAC. You have to verify the BAC Secretariat for sure they have them on file. bounce

No need. Under Se.54.4 of IRR of RA 9184:

54.4. Except for Limited Source Bidding under Section 49 of this IRR, submission of bid securities may be dispensed with.

For Nego (after Two-Failed Biddings), does the prospective bidders have to purchased the Bidding Documents?

Bidding Documents (under Sec.17) are only applicable for Public Bidding. You only have to determine your minimum terms, conditions, and specifications but it need not be in the form of Bidding Documents. Smile

ma'am, good morning po. based on our company's experience when we applied the negotiated procurement after 2 failed biddings, those who previously purchased the bidding documents for the 2 failed biddings were not required to purchase anymore but the new ones were required to purchase in order to join the negotiation.

good morning po, the reasons of 2 failed bidding that we had were; there is no local supplier can comply the specs and their quotes are higher than the ABC so we decided to have negotiated procurement. Is there any requirementsif we increase our ABC?

Provision of the law:

53.1. Two Failed Biddings. Where there has been failure of public bidding for the second time as provided in Section 35 of the Act and this IRR.

53.1.1. After conduct of the mandatory review of the terms, conditions, specifications, and cost estimates, as prescribed in Section 35 of this IRR, the BAC shall revise and agree on the minimum technical specifications, and if necessary, adjust the ABC, subject to the required approvals. However, the ABC cannot be increased by more than twenty percent (20%) of the ABC for the last failed bidding.(n)

53.1.2. The BAC shall invite and engage in negotiations with a sufficient number of suppliers, contractors or consultants to ensure effective competition.(a)
