Two months ago, our agency conducted bidding for Procurement of Infrastructure, the Project cost 8M plus. (After passing all the the requirements) Notice of Award was given to the Bidder likewise the contract has been signed by both parties (Agency and Contractor). But the HOPE decided not to push thru with the project.
The HOPE invoke Section 41. Reservation Clause which read
a. xxxx
b. xxxx
c.For any justifiable and reasonable ground where the award of the contract will not redound to the benefit of the Government as follows: (i) if the physical and economic conditions have significantly changed so as to render the project no longer economically, financially or technically feasible as determined by the head of the procuring entity; (ii) if the project is no longer necessary as determined by the head of the procuring entity; and (iii) if the source of funds for the project has been withheld or reduced through no fault of the procuring entity.

The HOPE communicated with the winning bidder with reason mention in the preceding paragraph, and the winning bidder responded to the HOPE in writing they are amenable with the proposal but on condition that he(Bidder) entitled to recover the expenses incidental to the bidding the likes of cost in securing bid documents, notarization expenses, xerox cost, etc. My question can the Winning bidder recover the expenses incurred considering the cost of the project involved?
