Eligibility check

Hi! may I just inquire re eligibility check.

If a bidder failed to submit his eligibility envelope on time because of an error committed by the BAC and BAC Secretariat, is it ok to allow him to submit the same later and just open the same to see if he is eligible?

No.

Under Sec.25 of the IRR of RA 9184:
25.1. Bidders shall submit their bids through their duly authorized representative using the
forms specified in the Bidding Documents in two (2) separate sealed bid envelopes,
and which shall be submitted simultaneously. The first shall contain the technical
component of the bid, including the eligibility requirements under Section 23.1 of this
IRR, and the second shall contain the financial component of the bid.

25.5. Bids, including the eligibility requirements under Section 23.1 of this IRR, submitted
after the deadline shall not be accepted by the BAC.

May we know what is that particular error committed by the BAC and BAC Secretariat?

they erroneosly sent a notice to the bidder that his MR for eligibility during the first project was denied while in fact the rbac resolution was for granting of the mr hence, the bidder was not able to secure an eligibility certification for the second project, unabling him to join the same.
