FAILURE IN SHOPPING

There was a failure in Shopping due to the bid of the suppliers exceeds the approved budget for the contract (ABC). Is it valid to adjust the ABC for re-advertisement & re-canvass purposes? What should be the process then if there was a failure of shopping as in this case?

No need for the re-advertisement, you just extend or add your canvass. If you originally canvass at least 3 suppliers, as an example, you can just request other suppliers to submit quotations until you find supplier(s) which is below your budget requirement.

Ma'am Avelino, I have related question. We posted on PhilGEPS under shopping but the lowest quotation (from 4 suppliers who submitted) we got exceeded the ABC by only 1%. Are we allowed to accept the lowest quotation due to immateriality? Thank you.

Hi!

You are not allowed to accept the lowest quotation which has exceeded the ABC. Section 31 of R.A. 9184 states that "The ABC shall be the upper limit or ceiling for the Bid prices. Bid prices that exceed this ceiling shall be disqualified outright from further participating in the bidding. xxxxx". The law is clear on this matter. The suppliers are all disqualified from participating in the procurement process.

Hello again. Related to the original question in this thread (and not related to my previous question), what if it appears that the ABC is really understated and that the prices quoted for the item (procured through shopping, not bidding) by independent suppliers exceed the ABC, is it acceptable to adjust the ABC and accept the quotations already submitted by suppliers? Or, should it be back to square 1 (i.e. re-advertise, get suppliers to submit new quotations, etc.)? Thank you again in advance.

Please be informed that the PhilGEPS system will not allow you to change the ABC, however, you could re-post it after review of the ABC for the project.

Yes sir, the premise is that there will be re-posting of the new revised purchase requirement with the revised ABC. The question is, can we consider the quotations received from suppliers who have submitted in response to the first posting? Or, should it be an entirely clean slate (back to square 1) where we should consider only those who responded to the re-posted purchase requirement?

Technically the re-post will be considered as a new posting in PhilGEPS. It might raise some issues/questions if you accepted a quotation prior to the date of posting of the undertaking @ PhilGEPS.

It is better for you to ask a new quotation from the same bidder.

Yes, you will revise you PR but first you must ensure that it is still in accordance to your PPMP. Also yes, you can cancel your posting in PhilGEPS but they will ask the reason for the cancellation. Hope this will help.
