APP mode of proc

Gud day..May i seek help if the mode of procurement which should be at the APP be transferred to PPMP? what will be the legal implication if we include the mode of procurement in the PPMP and not in the APP. The plan is we will just make a column in the APP indicating the PPMP Nr that has a mode of procurement. pls help me if this is possible.

The PPMP is prepared by the end-user. Although the PPMP is the basis of the APP, The mode of procurement indicated in the former is what the end-user may desire, but it is not binding on the BAC.

The recommendation on the mode of procurement rests with the BAC, so if the mode of procurement reflected in the PPMP is not applicable or is not allowed under RA 9184 and its IRR, then the BAC is duty bound to reflect in the APP the proper mode of procurement. The BAC cannot delegate the determination to the mode to the end-user or surrender its responsibility without incurring any liability in the end.
