Lowest Calulated Bid

Can one technical specification indicated by an agency that was not directly complied, be a basis of disqualifying a lowest calculated bidder? The specification can be complied by a substitute and has the same result.

From the IRR of RA 9184:

17.2. The specifications and other terms in the Bidding Documents shall reflect minimum
requirements or specifications required to meet the needs of the procuring entity in
clear and unambiguous terms.
If your proposal provided
  • a superior
  • a suitable substitute and
  • a compatible
specification, then it cannot be construed as non-complying, unless you expressly admit it. Smile

Can a lowest complying bidder be disqualified if he was not able to place in his reference documents the correct brochure for his bid?

i don't think that the "lockout" concept will do its intended purpose in gpra as all specs is set as a minimum requirements which can be overidden by a superior one as correctly pointed out by engrjhez®. it will also defeat the principle of competetiveness. in my opinion that concept should be avoided.
