Effectivity of Contract

The Invitation to Bid states that the goods is deliverable by September 7 2012 but no contract can be awarded on or before that date because of the absence of HOPE to sign the notice of award. What is the effectivity of the contract, should it be on the date stated in the invitation to bid or the date of the award?

Dates and durations of contract included in the Invitation to Bid are merely persuasive. The actual implementation will still depend when the award was issued and the date of the contract signing. From there, the implementation period will have to be adjusted.

Following Sec. 37.4.1 of the IRR, the contract effectivity date shall be provided in the Notice to Proceed (NTP) which shall not be later than seven (7) c.d. from the NTP issuance.

i think there is none, notice to proceed is just like any other letter, instructing the other party to start work as specified in the notice which will also be the contract effectivity date......

notice of award is a letter from the PE notifying the other party tthat the award have been given to them.

Notice of Award is a notification that the bid of the winning bidder had been accepted by the PE and that the former may now enter into a contract with the latter after submission of the required security whereas the Notice to Proceed is a notification of the execution or implementation of the contract specifying the effectivity of the contract.
