Absence of documents submitted by the bidders

Good morning!

May i just be clarified about the ff: issues:

1. A bidder failed to include a document in the 1st envelope ( technical ) , labelled original but the same document found in the copy 1 envelope. Shall we consider it FAILED or PASSED ?

2. A bidder submitted only 1 cd instead of 2 ( added requirement by the procuring entity in the Financial component containing the bill of quantities and detailed estimates). Shall we declare the bid as PASSED or FAILED ?

Following the non-discretionary PASS/FAIL criteria and considering that the BAC opens the original, a marking of FAIL is in order. The BAC cannot have the discretion of opening copies in separate envelopes just to check if it really present there.

Technically speaking, absence or patent insufficiency of any document or requirement is tantamount to a FAIL mark. However, additional requirements are supposed to be limited by that stipulated in the ITB consistent with the IRR. In such ruling, we presume that the CD requirement is part of the Financial Requirement as stated in the bidding documents and such requirement is valid. Assailing its validity is of course another story. Smile
