Does the exclusion of a Consultancy Services Contract in the Statement of On-going Contracts a non-compliance in a bid?

Our bid was post-disqualified for the non-inclusion of an on-going Consultancy Services Contract in the "Statement of all On-going Contracts including Awarded but not yet started".
We have excluded said contract in said statement for the simple reason that its nature is far detached from the contract bidded which is a road project. The Bid Document included two (2) Forms, namely: Statement of all Completed Contracts, Government or Private, that are Similar in Nature, and Statement of all On-going Contracts including Contracts Awarded but not yet started.

The Consultancy Services Contract that was on-going at the time of bidding was not included in the statement because it has no similarity whatsoever with the Contract to be bid. The Forms provided said so. Moreover, the Consultancy Services Contract does not entail any cost on our part except for office supplies which is negligible and could not affect any bit our firm's NFCC at the time.

Please share us enlightenment on this issue.

often times, simple mistakes could really devastate all the hard work. but i have to agree with the bac's determination to post disqualify in the above given scenario.

it is a direct violation of the omnibus sworn statement which could be a valid justification for disqualification.

irr 25.2.a.IV.(2)


Each of the documents submitted in satisfaction of the bidding requirements is an authentic copy of the original, complete, and all
statements and information provided therein are true and correct;
