LGU as a bidder

Good Afternoon.

The Bids and Awards Committee of our agency had already advertised an Invitation to bid for our project, Foods and Accommodation for the SBM Seminar. But during the procurement activities (issuance of bid docs), the Villa del Rey, operated by the LGU of Camarines Sur, showed interest in joining the said bidding. We would like to ask if in a public bidding, are local government units (LGU) are allowed to join?

i dont know if the irr prohibits this, but i am of the opinion that they may join any bidding as long as they are qualified.experts, please share your thoughs......

Go back to the eligibility requirements. Can the LGU submit a proof of registration, DTI/SEC/CDA? Can the LGU secure a Mayor's Permit for business? and others, until post qual? The answer is technically and obviously.... NO. Smile

hi nympha guemo,

imo,it is too early to make determinations who is allowed and who is not allowed to join the bid at this stage. allow everyone who shows interest... after all in the the screening, you will weed the eligible from the not eligible....

just my opinion,

It must probably redound to By-Administration kind of implementation because the buyer is also the implementor. It is one of a kind of situation and how it relate to the following:

RA 7160
Section 89. Prohibited Business and Pecuniary Interest. -

(a) It shall be unlawful for any local government official or employee, directly or indirectly, to:

(1) Engage in any business transaction with the local government unit in which he is an official or employee or over which he has the power of supervision, or with any of its authorized boards, officials, agents, or attorneys, whereby money is to be paid, or property or any other thing of value is to be transferred, directly or indirectly, out of the resources of the local government unit to such person or firm; XXXXXXX
