Failure to invite observers for the pre-bid conference

good morning everyone!

I would like to inquire on what will happen to our bidding if we failed to send the invitation to the observers three days before the pre-bid conference, I remembered the invitation a day before the pre-bid conference and had sent it thru fax.

The activities in the invitation includes: pre-bid, opening of bids, bid evaluation and other proceedings.

I would greatly appreciate your response.

Good afternoon, the law states that the BAC shall, in all stages of the procurement process, invite observers at least 3 calendar days before the date of the procurement activity. In your case, bidders, COA and/or any individuals who might have known of your lapses in complying with the required number of days in inviting observers may question the validity of the pre-bid conference that you have conducted. This will be the consequence. If I were you, I would have postponed the pre-bid conference and have it rescheduled to comply with the requirement.

The purpose of requiring a minimum 3 c.d. prior written notice or invitation to the observers is to afford them enough time to sort out their schedules so that hey are able to attend the pre-bid and the other stages of procurement.

If, however, you failed to give them the required minimum prior notice, but despite that they were able to attend anyway, I surmise that the bidding process would not be defective.
