Requiring SEC Issued General Information Sheet as part of Legal Document

May we request for legal opinion from the body:
1) Is the General Information Sheet (GIS) issued by Security Exchange Commission (SEC) a basic legal eligibility document during the bidding that failure to include it with the SEC Certificate of Registration is a ground for ineligibility of certain Bidder? The Bidder requested the BAC to require the submission of GIS only for post qualification since it was not stated in the bidding documents - Instructions to Bidders neither during the prebid conference. But the BAC immediately disqualified said bidder. Thank you for any clarification on this concern...

What is required for eligibility check is the SEC or DTI or CDA registration. Adding the GIS during eligibility check is beyond the requirement of the law, thus, out of line. during post qualification, GIS is not also required under the law, so why require. in my opinion, the bidder should not be disqualified.

I agree with Mam Regina, requiring additional documents that are not part of what is being required by law is contrary to the law. As long as the have submitted what are required by law then there is no reason that he must be disqualified.
