During opening of bid..

May bidding po kami..... yung ibang bidder ay representative lang po ng company yung nag attend not the authorized representative like yung nag pirma sa sworn at sa SPA... now during the opening of bid palagi po sya nag object sa BAC (like, under RA9184 blah..blah..blah ganito dapat form ginamit niya not like yung kung anong nandyan ngayon sa kanya.... at parang tinituruan po niya yung BAC kung ano gawin. Now my question is.. di po ba dapat BAC lang po may karapatan to decide whether tama yung Documents ng bidder or hindi? second, pwede po ba niya gawin yun since hindi naman sya yung authorized representative..

Puede naman na iba ang duly authorized representative ng bidder sa submission at opening ng bids kaysa doon naman sa authorized ng bidder na pumirma sa mga bid docs.

Ngayon sa opening ng bids, the BAC should be in total control ng proceedings.

Tama na ang BAC ang may karapatan na mag decide kung tama o hindi ang dokumento. Maaari naman na dinggin ng BAC ang mga objections ng bidders pero dun sa mga objections na hindi naman kailangan mag decide ang BAC, ang dapat gawin ng BAC ay sabihin sa bidders na meron naman sila 3 araw para mag file ng written requests for reconsideration. Saka lang mag decide ang BAC doon sa motion pagnatanggap ang request. Samantala, dapat lang na tuloy-tuloy ng BAC ang proseso para hindi maantala ang bid opening.
