query on approved pert-cpm and certification re: blacklisted supplier

good day everyone...

may i ask clarifications/assistance on this...

1. pert-cpm should be submitted by the winning bidder in an infra project, does this doc needed to be approved by the hope?

2. do we need to immediately require the submission of the following in the bid opening: s-curve, pert-cpm, equipment utilization sched, manpower sched etc.? if it is not reflected in our bid docs, are we mandated to include those items in the bds as other requirements?

3. what possible remedy can we do if some bid docs were lost like invitation to observers, attendance sheet? the previous bac lost it and it is one of the findings during the post audit and now they are requiring us to submit the said items... Sad

4. in case we overlap on the approved schedule of activities..example we have a total of 38cd activity period for a specific project but we finished the entire procedure like 100cd, are we committing a violation? (delaying the proc process) can we reason out that it is still within the latest allowable time which is 124cd.

5. coa as part of their requirement asks for a certification from philgeps that the bidder is not blacklisted..where can we find or secure such cert? we cant find it in a philgeps site and gppb list of blacklisted suppliers is not updated.

6. in the financial statement submitted by the bidder, is it necessary that it should be stamped received by the bir? if not would it be a ground for disqualification? in the term "it must be stamped received by the bir/or its duly authorized and accredited institution" who are these authorized or accredited institutions? the FS submitted to us was received by landbank of the phils, is it one of the accredited institution?

1. PERT-CPM submitted by the bidder should not be approved by the HOPE, it is only checked by the BAC whether the PERT-CPM coincide with the project duration of the procuring agency;
2. For infrastructure projects, construction schedule and S-curve, manpower schedule, construction methods, equipment utilization schedule, construction safety and health program and PERT/CPM should be part of the contract and this must be indicated in the bid docs. You can check this during post-qua stage;
3. I don't think that even an affidavit would suffice. You may ask COA what can be submitted in lieu of the missing documents mentioned;
4. You must not exceed the latest allowable days as required under the law for the completion of a particular project say 144 cd for infra project. If your project duration was set for 38 cd only but you finished it for 100cd, you must have valid, reasonable cause why such happened;
5. Call Gppb and request the updated list as of a particular date;
6. The law states that "the prospective bidder’s audited financial statements, showing, among others, the prospective bidder’s total and current assets and liabilities, stamped “received” by the BIR or its duly accredited and authorized institutions" government banking institutions are AABs such as landbank, veterans bank, etc.

The documents under Sec. 37.2.3 are contract documents. They may be required as part of technical documents but better required after award prior to contract signing.

37.2.3. The following documents shall form part of the contract:

g) Other contract documents that may be required by existing laws and/or the procuring entity concerned in the Bidding Documents, such as the construction schedule and S-curve, manpower schedule, construction methods, equipment utilization schedule, construction safety and health program approved by the Department of Labor and Employment, and PERT/CPM for infrastructure projects.

This is because such documents are more appropriately prepared by the winning bidder, being not so useful during bid evaluation. Smile
