Mode of Procurement

Local Governmant Unit last December 2012 procured an air conditioning system of the mall in the amount of 12 million, however the mode of procurement adopted by the LGU was Procurement of Goods. They will be installing several tonners of air conditioning units including the installation of the ducts, etc. Is the mode of procurement adopted by the BAC correct?

However, if the mode of procurement was procurement of civil works, are there any sanctions to be imposed on the BAC?

I would say that the project was "Supply and installation of airconditioning unit" which should be through public bidding. This is considered procurement of goods.

is installation which is defined by webster dictionary as 'putting up' or 'setting up' refers to the general support services in the definition of goods in the revised irr to qualify it as procurement of goods?

is it similar to supply and installation of gypsum board of the ceiling of a room - so you put the supply and installation of gypsum board as procurement of goods.

supply means to provide and deliver the materials or equipment - installation is the labor component = materials + labor + equipment or tools = construction or repair = infrastructure or civil works

please give me some details, how did you arrive for the supply and installation of air conditioning system amounting to 12 million as procurement of goods.

per IRR of RA No. 9184, the goods and infra are defined as follows:

a) Goods Refer to all items, supplies, materials and general support services, except
consulting services and infrastructure projects, which may be needed in the
transaction of public businesses or in the pursuit of any government undertaking,
project or activity, whether in the nature of equipment, furniture, stationery,
materials for construction, or personal property of any kind, including non-personal
or contractual services, such as, the repair and maintenance of equipment and
furniture, as well as trucking, hauling, janitorial, security, and related or analogous
services, as well as procurement of materials and supplies provided by the procuring
entity for such services. The term “related” or “analogous services” shall include, but
not be limited to, lease or purchase of office space, media advertisements, health
maintenance services, and other services essential to the operation of the procuring
entity.


b) Infrastructure Projects. Include the construction, improvement, rehabilitation,
demolition, repair, restoration or maintenance of roads and bridges, railways,
airports, seaports, communication facilities, civil works components of information
technology projects, irrigation, flood control and drainage, water supply, sanitation,
sewerage and solid waste management systems, shore protection, energy/power
and electrification facilities, national buildings, school buildings, hospital buildings,
and other related construction projects of the government. For purposes of, and
throughout this IRR, the term “Infrastructure Projects” shall have the same meaning
as, and shall be used interchangeably with, “civil works” or “works”.

based on the definition of goods and infrastructure projects or civil works in the irr, how do you classify the supply and installation of air conditioning system of a mall with ABC of 12 Million.

it depends on how it is appropriated in the budget and the scope of works in the POWE, if it involves more civil works or not.
