Contract and Notice to Proceed

I would like to inquire if the contract and notice to proceed may be issued at the same date to the winning bidder? The contract and NTP were already signed by the HOPE prior to issuance to the winning bidder.

Our Legal Department informed us that these two documents may be issued at the same time.

NTP can be issued only after the winning bidder have posted the required performance bond.

Yes. Contract and NTP may be issued at the same date. It is ideally that way especially when no approval from higher authority is required. Smile

How about if the mode is public bidding wherein performance bond is required, we still issue Contract and NTP at the same date ? Engrjhez what particular mode of procurement where no approval from higher authority is required ?

Performance Security/Bond is required to be posted prior to entering into contract.


39.1. To guarantee the faithful performance by the winning bidder of its obligations under the contract in accordance with the Bidding Documents, it shall post a performance security prior to the signing of the contract. (IRR, R.A. No. 9184)


Issuing the contract is deemed after its execution or perfection. The presumption is that the performance security/bond was already posted by the time of contract signing. It should not affect in any case the issuance of Contract and/or NTP. Smile
