50% Single Largest Contract: Procurement of Goods

Good day!

I would like to seek for your help on below concern.

We participated in a bid wherein the lowest calculated bidder, thru pass/fail criteria, where asked on his attachments on the single largest contract. Apparently, the declared single largest contract contains not just 1 item, hence, it was quite vague for TWG/BAC to know the amount of the item similar to the bid. We, the other bidder, were seated at the back of the checker (TWG/BAC) so we heard it. But the LCB was declared eligible subject to post-qualification.

In this regard, can we file for MR (?) - how do we call it? - or can we ask for a copy of the attachments being submitted by the LCB? Additionally, how many days after the opening of the bid are we allowed to submit the said MR?

You can't file an MR for a ruling where you are not directly affected. It may be dismissed outright. You cannot also ask for such documents from that bidder as no contact rule applies. Exception is when the BAC will have to clarify matters regarding your bid.

What you can do is to wait for the notice of bid results, and then you raise your concern. Smile

i read somewhere here that we can also wait for the notice to the losing bidders, upon receipt of which we can file a protest (should there be any) within 3 calendar days. additionally, we can ask for a copy of BAC's bid evaluation result. please confirm. Smile

You can only file a protest if you have availed of a request for reconsideration (MR) but was denied. You may request in the MR that you be enlightened on the part that is unclear for you.
