General Support Services - contract extension exceed one year

Good Morning,

I need your opinion, pls

Our agency procure Janitorial Services using Public Bidding.

Original Contract period : October 2, 2009 - October 1, 2012 or 3 years
Extension of contract : October 2, 2012 - October 1, 2013 or 1 year
No Contract : October 2, 2013 - November 27, 2013 (present) almost two (2) months

According to GPPB Resolution No. 023-2007, as amended 4.1 No contract extension shall exceed one (1) year.

Issue:

1. what is the accountability of the BAC for not comlying with GPPB Resolution No. 023-2007?
2. Is the Janitorial Services going to be compensated for the services they rendered from October 2 - November 27 (without contract)?

1. they may be subject to administrative and civil liabilities.
2. The resolution of gppb firmly stated that no contract extension should exceed 1 year. for every extension, there should be a contract. there is also a provision that if the extension exceeds 6 months, the HOPE shall immediately report to the GPPB in writing of its intent to extend beyond one year. there were 3 violations noted, the non-reporting of the HOPE to the GPPB for extension exceeding 6 months, the extension of the contract beyond 1 year and the extension without a contract.
3. the agency should still be compensated based on quantum meruit.
