PPMP AND APP

Good day!

I would like to ask your comments/suggestions on the below scenario:

a. PPMP 001 was included in the APP for CY 2013
b. Procurement of the items intended for the Project under PPMP 001 is not
completed yet and subject for procurement this CY 2014

Do we still need to prepare another PPMP of the remaining items to be procured
and have it reflected in the 2014 APP or the previous 2013 PPMP and APP will be ok?

Does the unfinished procurement of items for CY 2013 be reflected in the 2014 APP?

I don't think any 2013 project which were not yet completed as of 2014 need not be incorporated in the 2014 for as long as the Notice of Award for that particular project was issued in 2013.

No. Remember that APP is referring to and is consistent with the Approved Budget. So a different budget (and budget year) requires a separate APP.

No. Unfinished procurement of items for 2013 need not be reflected in the 2014 APP.

what happened if the end-user modify their POW? do they have to issue a revised PPMP? and another APP then? (ABC are being modified)

Uncompleted 2013 procurement (awarded but contract was not issued), 2014 budget shall be used

Good day, related to this topic, may I also inquire, what if the procurement has been awarded in 2013, However, the contract was not issued because we need to ask for approval from DBM-MITHI.  The approval was received on 2014, but there was no continuing appropriations, thus 2014 budget shall be used? should there a need to cancel the previous transaction.  What will happen to the awarded supplier? should the end user revise their ppmp?

Per Section 7.2. of the IRR of RA 9184 answer your question regarding the PPMP/APP "No procurement shall be undertaken unless it is in accordance with the approved APP of the procuring entity. The APP shall bear the approval of the Head of the Procuring Entity or second-ranking official designated by the Head of the Procuring Entity to act on his behalf, and must be consistent with its duly approved yearly budget."

Per COA Circular no. 97-004 "In the audit of payment of supplies, materials and equipment delivered, regardless of the mode of procurement, the following documents shall be required:
1. Request for purchase or requisition of supplies, materials and equipment or its equivalent, duly approved by proper authorities; x x x"

While R.A. No. 9184 and its IRR make use of PPMP and APP in procurement, you cannot simply do away with PR. Purchase Request or PR is one imposed by COA. Being an independent constitutional body, it has authority to impose forms for the usual accounting and auditing matters. Ligaw na Binatog cited the legal bases for the said forms.

While I am personally in the opinion that PRs are already "obsolete" so to speak, we cannot do away with it unless the COA themselves withdraw it from their requirements.

ask ko lang po is it the BAC Secretariat the one who prepare and or consolidate our LGU's APP?

Yes. The Implementing Rules and Regulation of R.A. No. 9184 is clear:

7.3.4. After the budget proposal has been approved by the Head of the Procuring Entity and/or other oversight bodies, the procuring entity’s budget office shall furnish a copy of the procuring entity’s budget proposal as well as the corresponding PPMPs to the BAC Secretariat for its review and consolidation into the proposed APP.

7.3.5. As soon as the GAA, corporate budget, or appropriation ordinance, as the case may be, becomes final, the end-user units shall revise and adjust the PPMP to reflect the budgetary allocation for their respective PAPs. The revised PPMPs shall be submitted to the BAC, through its Secretariat, for the finalization of the modes of procurement under the proposed APP. The APP shall then be approved in accordance with Section 7.2 of this IRR. (underscoring supplied)
